TERMS & CONDITIONS FOR PHOTOSHOOTS

This page details the current Terms and Conditions for Mak Freeman Photography. These Terms apply when you are ready to book a date for your photoshoot session.

Thank you for booking a photoshoot with Mak Freeman Photography, referred to as me, I, my, or the photographer. Please read these Terms and Conditions carefully, as they apply to you, referred to as the client, and to your booking of photography services, photo shoot session, or sitting.

I am happy to answer any questions or concerns you may have in relation to these Terms and Conditions at any time. However, continuing with your booking, making payment, or attending the photoshoot confirms your agreement to these Terms.

I reserve the right to amend or update these Terms and Conditions at any time. Where changes are made after a booking, reasonable notice will be provided. The version in force at the time of booking will apply.

These Terms and Conditions constitute the entire agreement between the parties and supersede all previous agreements or understandings relating to the photography services. No variation, amendment, or agreed termination of these Terms or any related document shall be effective unless confirmed in writing.

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. A person who is not a party to this agreement has no rights under or in connection with it.

This agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of England and Wales.

ACCEPTANCE

Your booking and or payment of any session fee signifies acceptance of these Terms and Conditions as a legally binding agreement, unless explicitly objected to in writing prior to accepting my services.

Any booking or payment made to me confirms that you have read, understood, and agreed to all Terms set out in this document in full. Where a dispute arises, both parties agree to attempt to resolve the matter amicably in the first instance. This does not remove or limit your statutory right to pursue legal remedies.

COPYRIGHT AND OWNERSHIP

The copyright and all intellectual property rights in all photographs remain the property of Mak Freeman Photography. The photographer asserts the moral right to be identified as the author of the images in accordance with the Copyright, Designs and Patents Act 1988.

Any unauthorised copying, reproduction, alteration, distribution, or modification of images constitutes a breach of copyright. This includes screenshots, screen recordings, or copying of images shared online.

From time to time, the photographer may provide preview images, sneak peeks, or access to an online gallery. These images must not be copied, downloaded, altered, shared, or screenshotted in any form.

Images may only be shared publicly once purchased and paid for in full. Where images are shared on social media, websites, or other platforms, the photographer must be credited as Mak Freeman Photography, together with a link to makfreemanphotography.com where possible.

MARKETING AND PROMOTIONAL USE

Unless otherwise agreed in writing prior to the photoshoot, the photographer retains the right to use selected images for portfolio use, website content, social media, marketing, advertising, editorial, and promotional purposes.

If you do not wish your images to be used publicly, this must be communicated in writing before the photoshoot takes place. Requests made after the session may not be accepted.

MODEL CONSENT

By attending and participating in the photoshoot, you grant permission for the photographer to use your images as described in these Terms. This consent applies to all participants unless otherwise agreed in writing prior to the session.

BOOKING AND RESERVATIONS

Your photoshoot session is reserved only once payment has been received. Session fees are non refundable if cancellation occurs more than seven days after the booking has been confirmed. This policy secures the photographer’s availability, locks the date, and compensates for time allocated to preparation and lost booking opportunities.

RESCHEDULING AND CANCELLATIONS

It may occasionally be necessary for either party to reschedule due to unavoidable circumstances such as injury or serious illness. Where this occurs, one reschedule may be permitted within a three month period, subject to availability. Notice must be given as soon as reasonably possible and no later than fourteen days before the scheduled session.

Once a photoshoot is booked, cancellation is not permitted after seven days from booking. This policy exists to ensure that the photographer’s time and resources are protected. Clients should carefully consider their availability before committing to a booking.

No refunds are offered once a photoshoot is booked. In recognition of your commitment, where cancellation is necessary, a voucher equivalent to the value of the deposit may be issued at the photographer’s discretion. Vouchers are non transferable and may be used towards a future photoshoot.

PRICES AND PAYMENTS

The price for your photoshoot session is agreed at the time of booking. Payment of the session fee secures the current rate. Sessions rescheduled at the client’s request may be subject to the prices in effect at the time of rescheduling.

All prices are in pounds sterling. Prices displayed on the website or marketing materials may be subject to change. The photographer reserves the right to update pricing without prior notice.

All photoshoot sessions must be taken within twelve months of payment unless otherwise agreed in writing.

The remaining balance must be paid in full before final edited images are delivered. Payment may be made by bank transfer or card payment via the website.

Where card details are provided, the remaining balance may be charged automatically forty eight hours prior to the photoshoot date or on the day of the session. If a payment fails or is declined, you will be contacted to arrange payment by alternative means.

IMAGE DELIVERY

Edited images will be delivered via a private online gallery or secure download link. Delivery times are provided as an estimate and may vary depending on workload, season, or unforeseen circumstances.

Images will not be delivered until full payment has been received and all outstanding balances cleared.

IMAGE EDITING

Basic retouching is included in all packages. This includes colour correction, light skin retouching, and general image clean up.

Advanced retouching such as body reshaping, heavy skin alteration, background removal, or object removal is not included unless agreed in advance and may incur additional charges.

While reasonable care is taken during editing, it is not always possible to remove marks, creases, hair issues, or other temporary details. Clients are responsible for preparing themselves as they wish to appear in the final images prior to the session.

CREATIVE LICENCE

You grant the photographer full creative licence to capture, select, edit, and deliver images in the style and method consistent with the photographer’s portfolio and advertised work. Final image selection and editing decisions remain at the photographer’s discretion.

IMAGE ARCHIVING

Images will be stored for up to three months from the date of the photoshoot. After this period, files may be permanently deleted. It is the client’s responsibility to download and securely back up their images.

MY OBLIGATIONS

I will use reasonable endeavours to provide the photography services described on my website and marketing materials in a professional manner.

I reserve the right to refuse or discontinue a session where health, safety, or wellbeing is at risk to any person involved.

YOUR OBLIGATIONS

You agree to cooperate fully and provide all information reasonably requested to allow the photography services to be carried out. You agree to follow directions provided during the session and ensure a safe and respectful environment.

LIABILITY

In the unlikely event of equipment failure, loss of images prior to delivery, illness, injury, or circumstances beyond my reasonable control, liability shall be limited to a refund of monies paid.

I shall not be liable for events beyond reasonable control, including weather conditions, venue issues, supplier failure, government restrictions, or third party actions.

Total liability for any claim, including negligence, shall be limited to the fees paid for the photography services. I shall not be liable for indirect, consequential, or economic losses.

In the event of incapacitating illness or injury, I may arrange a replacement photographer where possible. If this cannot be agreed, a refund of fees paid will be issued.

Directions given during a photoshoot are followed at the client’s own risk. Mak Freeman Photography is not responsible for personal accidents during a photoshoot.

Mak Freeman Photography is not responsible for services provided by third parties. Your statutory rights remain unaffected.

DATA PROTECTION AND PRIVACY

Personal data is handled in accordance with applicable data protection laws. Further details are available in the Privacy Policy published on the website.

INSURANCE

Mak Freeman Photography holds Public Liability Insurance.
