Terms and Conditions apply to all group photoshoots booked with Mak Freeman Photography. By making a booking or payment, you agree to be bound by the following terms.
ABOUT THESE TERMS
References to Mak Freeman Photography, we, us, or the photographer mean Mak Freeman Photography. References to you, the client, coach, or organiser mean the individual or business making the booking. Participants refer to all individuals attending or taking part in the photoshoot.
These Terms apply to all photography services unless otherwise agreed in writing. We reserve the right to update these Terms from time to time. The version in force at the time of booking will apply.
ACCEPTANCE OF TERMS
By booking a photoshoot and or making any payment, you confirm that you have read, understood, and accepted these Terms and Conditions as a legally binding agreement. No variation to these Terms shall apply unless agreed in writing prior to the photoshoot.
GROUP BOOKINGS AND RESPONSIBILITY
When booking a group photoshoot, the organiser agrees to a fixed number of participants. This number is binding and forms the basis of the agreed pricing and time allocation.
In the event of cancellations, dropouts, or non attendance by participants, the organiser remains responsible for the full agreed fee. No reduction in price will be offered due to a reduced number of participants.
The organiser is responsible for ensuring that all participants are aware of and agree to these Terms and Conditions before the photoshoot takes place.
BOOKING, RESERVATIONS, AND FEES
A photoshoot date and time are secured only once payment has been received. Session fees are non refundable if cancellation occurs more than seven days after the booking has been confirmed. These fees contribute towards time spent reserving the date, planning, and preparation.
Bookings are not confirmed until payment has cleared. We reserve the right to cancel or reschedule a session if payment is not received as agreed.
PRICES AND PAYMENTS
All prices are agreed at the time of booking and are shown in pounds sterling. Booking your session secures the current rate.
If a session is rescheduled at the client’s request, the session may be subject to the prices in effect at the time of rescheduling.
Full payment must be made before final edited images are delivered. Payment may be made by bank transfer or card payment via the website.
All photoshoot sessions must take place within twelve months of payment unless otherwise agreed in writing.
RESCHEDULING AND CANCELLATIONS
Rescheduling may be permitted once within a three month period due to unavoidable circumstances such as injury or serious illness. Requests must be made as soon as possible and no later than fourteen days before the scheduled session. All rescheduled dates are subject to availability.
No refunds are provided once a photoshoot is booked. If a session is cancelled, a voucher equal to the value of the deposit may be issued at our discretion. Vouchers are non transferable and may only be used towards a future photoshoot.
IMAGE DELIVERY AND TURNAROUND
Edited images will be delivered via a private online gallery or secure download link. Delivery times are provided as an estimate and may vary depending on workload, season, or unforeseen circumstances.
Images will not be delivered until full payment has been received and any outstanding balances cleared.
IMAGE SELECTION AND EDITING
Basic retouching is included in all packages. This includes colour correction, light skin retouching, and general image clean up.
Advanced retouching such as body reshaping, heavy skin alteration, background removal, object removal, or stylistic changes outside the photographer’s usual style are not included unless agreed in advance and may incur additional charges.
CREATIVE CONTROL AND STYLE
The photographer retains full creative control over how images are captured, selected, edited, and delivered. Image selection, composition, and final editing style are at the photographer’s discretion.
Requests for specific shots or styles may be considered but are not guaranteed.
COPYRIGHT AND IMAGE OWNERSHIP
All images remain the copyright of Mak Freeman Photography. No images may be copied, altered, reproduced, screenshotted, or otherwise used without permission.
Purchased images may be shared on personal or business social media platforms provided that Mak Freeman Photography is clearly credited and a link to the website or social profile is included.
MARKETING AND PROMOTIONAL USE
The photographer may use selected images for portfolio, website, social media, marketing, advertising, and promotional purposes.
If you do not wish images to be used publicly, this must be communicated in writing before the photoshoot takes place. Requests made after the session may not be accepted.
MODEL CONSENT
By attending and participating in the photoshoot, all participants grant permission for the use of their images as outlined in these Terms unless otherwise agreed in writing prior to the session.
LATE ARRIVAL AND NON ATTENDANCE
Late arrival may result in reduced shooting time. No additional time will be added, and no refund will be offered.
Failure to attend the photoshoot without notice will result in the session being forfeited with no refund or reschedule.
LOCATIONS, VENUES, AND ACCESS
If a location becomes unavailable due to circumstances beyond our control, an alternative location or reschedule may be offered.
Any additional venue hire fees, access charges, or travel costs incurred as a result of location changes will be the responsibility of the client.
WEATHER CONDITIONS
Where weather conditions prevent the photoshoot from taking place safely or reasonably, rescheduling may be offered at the photographer’s discretion.
MINORS
Photoshoots involving individuals under the age of eighteen require written consent from a parent or legal guardian prior to the session.
IMAGE STORAGE AND ARCHIVING
Images will be stored for up to three months from the date of the photoshoot. After this period, files may be permanently deleted. It is the client’s responsibility to download and back up their images.
LIABILITY AND LIMITATION
In the unlikely event of equipment failure, loss of images prior to delivery, illness, injury, or circumstances beyond our control, liability is limited to a refund of monies paid.
We are not responsible for delays, losses, or failure to perform due to events beyond reasonable control, including but not limited to weather, venue issues, supplier failure, or government restrictions.
INSURANCE
Mak Freeman Photography holds Public Liability Insurance.
COMPLAINTS AND FEEDBACK
Any concerns or complaints must be submitted in writing within seven days of image delivery. After this period, the services will be deemed accepted.
GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales.
